Comunidad sanmarquina analiza modificaciones al Estatuto universitario

Hasta el mes de noviembre del presente año, la comunidad sanmarquina tiene la oportunidad de presentar sus propuestas de modificación del Estatuto de la Universidad Nacional Mayor de San Marcos (UNMSM), documento que norma el funcionamiento de este centro superior de estudios para el cumplimiento de sus principios y fines, en adecuación a la Ley Universitaria 30220.

Dicha norma, vigente desde el 6 de junio de 2016 luego de su aprobación por la Asamblea Estatutaria, incluyó importantes cambios estructurales, de gestión, académicos y administrativos que se vienen implementando hace más de tres años en las diversas áreas de la universidad.

Durante este tiempo, la comunidad universitaria está observando varios puntos del documento en cuanto a la adecuación de la nueva Ley Universitaria, razón por la cual, la Asamblea Universitaria consideró oportuno la conformación de una Comisión Revisora del Estatuto que tiene como funciones recibir todas las propuestas de estudiantes, docentes y administrativos; así como también analizar y evaluar —como comisión— los diversos capítulos y artículos que podrían tener alguna modificación.

“Es importante que entendamos todos, como comunidad universitaria, que lo que se busca con esta revisión es mejorar el Estatuto para que podamos tener procesos administrativos más rápidos y más eficientes que permitan viabilizar algunos aspectos que estamos abordando y que, quizá, no nos está ayudando en el cumplimiento de las funciones”, señaló la doctora Betty Millán Salazar, decana de la Facultad de Ciencias Biológicas (FCB) y presidenta de la Comisión Revisora, aprobada con la Resolución Rectoral N.º 04614-R-19.

Complementan este grupo de trabajo los docentes principales Margot Gutiérrez Ilave (Odontología), Alfredo Delgado Castro (Medicina Veterinaria) y Víctor Crispín Pérez (Farmacia y Bioquímica).

Según explica la doctora Millán, en cada sesión de la citada comisión se revisan las propuestas de modificación del estatuto que hacen llegar los miembros de la comunidad sanmarquina, ya sea a título personal o de las facultades que recogen el sentir de su plana docente. Luego de ello, será presentado el informe final al rector, doctor Orestes Cachay Boza, para que pueda convocar a una sesión de la Asamblea Universitaria, órgano que deberá debatir y, de ser el caso, aprobar la propuesta de la Comisión Revisora del Estatuto.

En ese sentido, se invita a todos los docentes, estudiantes, administrativos a que participen en el análisis de la experiencia de estos tres años de implementación del estatuto como un aporte a la mejora de la universidad. Las propuestas deberán especificar el capítulo y artículo respectivo con su debida sustentación.

Dicha documentación será presentada en la Oficina de Comisiones Permanentes y Transitorias, ubicada en la oficina N.º 306, tercer piso del edificio Jorge Basadre de la sede central.

    «De acuerdo a lo precisado en el artículo 103º de la Constitución Política del Perú y en el artículo III del Título Preliminar del Código Civil, donde se recoge la “Teoría de los hechos cumplidos”, las leyes no son retroactivas; y por consiguiente lo establecido en la tercera disposición complementaria Transitoria de la ley 30220 (requerimiento de tener el grado de magister o doctor) no será aplicado retroactivamente para bajar de categoría ni retirar de la universidad a los docentes que ingresaron a la docencia a la UNMSM antes de la sentencia del tribunal constitucional del 10 de Noviembre del 2015»

    Un sustento adicional es la no retroactividad de la obligatoriedad de presentar tesis de bachiller a los estudiantes que ingresaron antes de la aplicación de la ley 30220. Por consiguiente, a situaciones similares se deben aplicar las mismas decisiones.
